Kathy Szczesny. (“me”, “I”, or “my”) operates www.kathyszczesny.dev (the “Site”).

This Privacy Policy informs you of my policies regarding the collection, use and disclosure of personally identiﬁable information I receive from users of the Site. It also describes the choices available to you regarding my use of your Personal Information (also known as “personal data”) and how you can access and update that information. Personal Information is information about you that can be used, directly or indirectly, to identify you (e.g., name, email address, mailing address, date of birth).

I use your Personal Information only for the purposes of registration, billing, and improving the Site. However, in order to fulfill my service obligations to you, I will continue to send you emails regarding your account administration, as well as any necessary information, such as renewal notices and instructions. By providing me with your email address you consent to receiving communications from me electronically and all notices, disclosures and other communications that I provide to you electronically satisfy any legal requirement that such communications be in writing.

Compliance With Legal Or Law Enforcement Requests

I cooperate with government and law enforcement officials and private parties to enforce and comply with the law. I will disclose any information about you to government or law enforcement officials or private parties as we, in my sole discretion, believe necessary or appropriate to respond to claims and legal process (such as subpoena requests), to protect my property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity I consider to be illegal or unethical. When permitted, I will disclose to any customer that is the subject of a government investigation and any data requests pertaining to customers’ Personal Information and/or hosted data.

Transfer of Personal Information Abroad

If you utilize my services from a country other than the country where my servers are located, your communications with me may result in transferring your Personal Information across international borders. Also, when you call me or initiate a chat, I may provide you with support from outside your country of origin. In these cases, your Personal Information is handled according to this Privacy Policy.

Your Rights Over Personal Information I Control

I will respond to your request for access or to modify or deactivate your information within thirty (30) days.

If your Personal Information is not reasonably necessary for the provisioning of the services or for the operation of my system, you will have the choice to withdraw your consent by opting out. My Site may contain links to other sites that are not operated by me. If you click on a third-party link, you will be directed to that third party’s site. Changes to This Privacy Policy

I may update this Privacy Policy from time to time. I will notify you of any changes by posting the new Privacy Policy on the Site. You are advised to review this Privacy Policy periodically for any changes.

Age Restrictions

My services are not targeted to, intended to be consumed by or designed to entice individuals under the age of 18. If you know of or have reason to believe anyone under the age of 18 has provided me with any Personal Information, please contact me.

California Residents

If you are a resident of the State of California, this Section addresses your rights and my obligations under the California Consumer Privacy Act of 2018 (“CCPA”). Terms used in this Section have the same meaning as provided in the CCPA.

Information I Collect

My Site collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, my Site has collected the following categories of personal information from visitors within the last 12 months:

Access to Specific Information and Data Portability Rights

Deletion Request Rights

You have the right to request that I delete any of your personal information that I collected from you and retained, subject to certain exceptions. Once I receive and confirm your verifiable consumer request, I will delete (and direct my service providers to delete) your personal information from my records, unless an exception applies.

I may deny your deletion request if retaining the information is necessary for me or my service provider(s) to:

Complete the transaction for which I collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of my ongoing business relationship with you, or otherwise perform my contract with you.
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
Comply with a legal obligation.
Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, you can contact me as described below. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows me to reasonably verify you are the person about whom I collected personal information or an authorized representative.
Describe your request with sufficient detail that allows me to properly understand, evaluate, and respond to it.

I cannot respond to your request or provide you with personal information if I cannot verify your identity or authority to make the request and confirm the personal information relates to you. I will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

I endeavor to respond to a verifiable consumer request within 45 days of its receipt. If I require more time, I will inform you of the reason and extension period in writing. I will deliver my written response by mail or electronically, at your option. Any disclosures I provide will only cover the 12-month period preceding my receipt of your request. The response I provide will also explain the reasons I cannot comply with a request, if applicable. For data portability requests, I will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.

I do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If I determine that the request warrants a fee, I will tell you why I made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

I will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, I will not:

Deny you goods or services.
Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
Provide you a different level or quality of goods or services.
Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, I may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive I offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of my Website that are California residents to request certain information regarding my disclosure of personal information to third parties for their direct marketing purposes.
